Live Kanvas enables you to discover and enjoy content as part of an engaging social streaming service. This Privacy Statement explains how we collect, use, and disclose your personal information when you use the “Live Kanvas” service to access “Live Kanvas” content as those terms are defined in the Live Kanvas Terms of Use. Certain functionalities or apps that are part of the Live Kanvas service may also provide you with contextual privacy information or choices, in addition to the information and choices described in this Privacy Statement. We may also provide additional information about how we use your data within the app or service to give you an opportunity to review this feature-specific information before you use those features.

 

  1. Our Collection, Use, and Disclosure of Personal Information

We collect the following categories of personal information about you:

 

  • Personal details: When you create your Live Kanvas account, we may collect some or all the following information that is associated with your Live Kanvas account (such as name, age, gender, username, password, language, email, phone number, social media account information, and profile image.)
  • Payment details: Transactions through Apple Pay, Google Pay, or Stripe may provide us with payment confirmation but not full financial details.
  • Usage information: We collect information about your interaction with the Live Kanvas service (including playback events, such as play, pause, etc.), choices made when engaging with interactive titles, and other information about your use and interaction with the Live Kanvas service (such as app clicks, time and duration of access, and camera/photo access for live streams.)
  • Advertising information: If you subscribe to an ad supported subscription plan, we collect information about the ads on Live Kanvas that you view or interact with, device information (such as resettable device identifiers), IP addresses, and information provided by Advertising Companies (such as information about your likely interests they have collected or inferred from your visits to other websites and apps). We use this information to display Advertisements to you in the Live Kanvas service (including behavioral advertisements in accordance with your preferences).
  • Metadata: When you upload or create User Content, you automatically upload certain metadata that is connected to the User Content. Metadata describes other data and provides information about your User Content that will not always be evident to the viewer. For example, in connection with your User Content the metadata can describe how, when, where, and by whom the piece of User Content was created, collected, or modified and how that content is formatted. It also includes information, such as your account name, that enables other users to trace back the User Content to your user account. Additionally, metadata includes data that you choose to provide with your User Content, e.g., any hashtags used to mark keywords to the video and captions.
  • Device and network information: We collect information about your computer or other Live Kanvas capable devices you might use to access our service (such as smart TVs, mobile devices, and other streaming media devices), your network, and network devices. The information includes:
  • device IDs or other unique identifiers, including for your network devices (such as your router), and devices that are Live Kanvas capable on your network;
  • IP addresses (which can be used to tell us the general location of your device, such as your city, state/province, and postal code);
  • device and software characteristics (such as type and configuration), referring source (for example, referrer URLs), standard web browser and mobile app log information, and connection information including type (such as Wi-Fi or cellular);
  • performance data such as crash reports, timestamps, and debug log messages; and
  • cookie data, resettable device identifiers, advertising identifiers and other unique identifiers (described below in the section “Cookies and Internet Advertising”).
  • Communications: If you communicate with Live Kanvas (such as contacting customer support via online chat), engage in our surveys or feedback requests (such as when you cancel), we collect the contents of such communications. We also collect details of communications that we send you (such as via email, push notifications, text message, or within the Live Kanvas service), and information about your interaction and engagement with these communications.

 

  1. Where We Collect Personal Information From

We collect your personal information from the following sources:

 

  • Directly from you: When you register with the Live Kanvas service, update your Live Kanvas account or profile, correspond with us, or respond to our surveys, you may provide (and we will collect) the following categories of personal information: personal details, payment details, account and profile information, such as name, age, username, password, language, email, phone number, social media account information, and profile image.
  • User-generated content: This includes comments, photographs, livestreams, audio recordings, videos, text, hashtags, and virtual item videos that you choose to create with or upload to the Platform (“User Content”) and the associated metadata, such as when, where, and by whom the content was created.
  • Messages: Which include information you provide when you compose, send, or receive messages through the Platform’s messaging functionalities. They include messages you send through our chat functionality when communicating with users. That information includes the content of the message and information about the message, such as when it was sent, received, or read, and message participants. Please be aware that messages you choose to send to other users of the Platform will be accessible by those users and that we are not responsible for the manner in which those users use or share the messages.
  • Contacts: Your phone and social network contacts, with your permission. If you choose to find other users through your phone contacts, we will access and collect information such as names, phone numbers, and email addresses, and match that information against existing users of the Platform. If you choose to find other users through your social network contacts, we will collect your public profile information as well as names and profiles of your social network contacts.
  • Automatically when you use our service: We automatically collect the following categories of personal information in connection with your use of the Live Kanvas service: Live Kanvas account/profile information, usage information, advertising information, device and network information, and communications.
  • From Partners whose products and services you use: We may collect the following categories of personal information about you from third parties whose services you use to access, pay for, or interact with the Live Kanvas service (“Partners”): personal details, payment details, usage information, and device and network information. The categories of personal information that Partners provide to us will vary depending on the nature of the Partner and your relationship with them. Our Partners may include your TV manufacturer, internet service provider, streaming media device provider, mobile phone carriers, or other companies who collect payment for the Live Kanvas service. For example, Partners may provide us:
  • personal details (such as your email address), device and network information (such as IP addresses, device IDs, or other unique identifiers), or other personal information in order to activate the Live Kanvas service, or present Live Kanvas content to you through portions of the Partner’s user interface;
  • payment details (such as associated pre-paid promotions and billing information) if they are assisting with billing or collecting payment for the Live Kanvas service; and
  • search queries and commands applicable to Live Kanvas that you make through Partner devices or voice assistance platforms.
  • From other sources: We may collect the following categories of personal information about you from other sources: personal details, payment details, email, contact list and device and network information. These sources include:
  • If you choose to sign-up or log-in to the Platform using a third-party service such as Facebook, Apple, or Google, or link your Live Kanvas account to a third-party service.
  • Service Providers such as vendors, agents, and contractors that collect or provide personal information to Live Kanvas in connection with services they perform on our behalf (“Service Providers”). This may include Service Providers such as those that:
  • help us determine a general geographic location based on your IP address in order to customize our service and for other uses consistent with this Privacy Statement;
  • provide us with information to secure our systems, prevent fraud, and help us protect the security of Live Kanvas and our users;
  • provide us with payment processing services including payment or balance information, or updates to that information.
  • Advertising Companies: If you subscribe to an ad supported subscription plan, we may collect advertising information about you from other sources, including (collectively referred to as “Advertising Companies”):
  • Advertisers that run Advertisements on Live Kanvas (“Advertisers”) may provide us with unique identifiers (for example, cookies or resettable device identifiers), demographic information and other information (such as information about your likely interests they have collected or inferred based on your activities online) in order to deliver Advertisements;
  • service providers that facilitate the sale, operations, and management of Advertisements (“Ad Service Providers”)
  • ad measurement companies that support Live Kanvas and Advertisers in understanding the effectiveness of Advertisements run on Live Kanvas (“Ad Measurement Companies”); and
  • online and offline information providers to support Advertisements (for example, by providing your general location information based on your device’s IP address, such as city, state, and postal code).

 

  1. GDPR Compliance (For EU Users)

Under the General Data Protection Regulation (GDPR), if you are in the European Economic Area (EEA), you have the following rights:

 

  • Right to Access: Request a copy of the personal data we store.
  • Right to Rectification: Correct inaccurate or incomplete information.
  • Right to Erasure: Request deletion of your data, subject to legal obligations.
  • Right to Restrict Processing: Limit how your data is used.
  • Right to Data Portability: Obtain your data in a portable format.
  • Right to Object: Opt-out of certain data processing, including marketing communications.

  1. How We Use Your Personal Information

We use your personal information to provide, maintain, improve, and promote the Live Kanvas service, and to communicate with you. This involves using the categories of personal information listed above for the following purposes:

  • To provide our service including all features and functionalities, websites and apps, user interfaces, and content and software associated with the Live Kanvas service. This includes personalized recommendations for Live Kanvas content that we think will be of interest to you. This may also include personalizing the features and functionalities of the service (such as the way in which the recommendations are presented to you) and localizing Live Kanvas content relevant to your geography. We use the following categories of personal information for this purpose: personal details, Live Kanvas account/profile information, usage information, device and network information, and communications.
  • To administer and operate our business including purposes such as processing payments and sending transactional communications to you (such as confirmation of subscription start date or information about changes to your account), responding to your inquiries and requests, and assisting you with operational requests such as password resets. We use the following categories of personal information for this purpose: personal details, payment details, Live Kanvas account/profile information, usage information, device and network information, and communications.
  • To use User Content as part of our advertising and marketing campaigns to promote the Platform.
  • To support the social functions of the Platform, including to permit you and others to connect with each other (for example, through our Find Friends function), to suggest accounts to you and others, and for you and others to share, download, and otherwise interact with User Content posted through the Platform.
  • To promote the safety and security of the Platform, including by scanning, analyzing, and reviewing User Content, messages and associated metadata for violations of our Terms of Service, Community Guidelines, or other conditions and policies.
  • To train and improve our technology, such as our machine learning models and algorithms.
  • To research, analyze, and improve our services such as analyzing and understanding our audience to improve our services and optimize Live Kanvas content selection and service delivery. This may also include processing your personal information in connection with any surveys you participate in. We use the following categories of personal information for this purpose: personal details, payment details, Live Kanvas account/profile information, usage information, device and network information, and communications.
  • To send marketing and informational messages including news and promotional communications about our service, new features, available Live Kanvas content, and special offers, as well as Live Kanvas marketing on third party services. Depending on the nature of the message we send, we may use the following categories of personal information for this purpose: personal details, Live Kanvas account/profile information, usage information, device and network information, and communications.
  • To operate our ad supported subscription plan including to provide, analyze, administer, enhance, optimize, select, and deliver Advertisements. We use the following categories of personal information for this purpose: personal details, Live Kanvas account/profile information, usage information, advertising information, and device and network information.
  • We use your personal information to present you with Advertisements. Some of our Advertisements may be behavioral advertisements (“behavioral advertisements” are those that are selected based on information about your use and/or interactions with unaffiliated third party services). Within our ad supported subscriptions plan, behavioral advertisements may be based on information regarding your use and/or interactions with unaffiliated third party services provided to us by Advertising Companies (see definition above). 
  • For safety, security, and fraud prevention including to secure our systems, protect our business, and to investigate, prevent, and detect prohibited or illegal activities and other security/technical issues. We use the following categories of personal information for this purpose: personal details, payment details, Live Kanvas account/profile information, usage information, advertising information, device and network information, and communications.
  • To comply with law and enforce our Terms of Use including to satisfy applicable law, regulation, legal process, or governmental request, and to protect against harm to the rights, property or safety of Live Kanvas, its users or the public, as required or permitted by law. This also includes enforcing our terms, such as determining whether and for which Live Kanvas signup offers you are eligible and whether a particular device is permitted to use the account consistent with our Terms of Use. We use the following categories of personal information for this purpose: personal details, payment details, Live Kanvas account/profile information, usage information, advertising information, device and network information, and communications.

 

  1. How We Disclose Personal Information To:

We may disclose your personal information to the following parties:

 

  • Live Kanvas Entities: We share your personal information among Live Kanvas entities as needed for the following purposes: to provide our service; to administer and operate our business; to research, analyze, and improve our services; to enable Partner integrations and promotions; to send marketing and informational messages; to operate our ad supported subscription plan; for safety, security, and fraud prevention; and to comply with law and enforce our Terms of Use.
  • Service Providers: We use Service Providers to perform services on our behalf or to assist us with the provision of services to you. For example, we use Service Providers to provide communications, security, infrastructure and IT services, to personalize and improve our service, and to process payments. We do not authorize them to use or disclose your personal information except in connection with providing their services (which may include maintaining and improving their services). To help maintain the safety and security of our service and users, we and our Service Providers may monitor and record message content (such as chat functionality) to identify harmful behavior, security risks, and violations of our Terms of Use and community guidelines. Our Service Providers may process your personal information for the following purposes: to provide our service; to administer and operate our business; to research, analyze, and improve our services; for safety, security, and fraud prevention; and to comply with law and enforce our Terms of Use.
  • Marketing providers: Live Kanvas Marketing Providers may process your personal information for the following purposes: to research, analyze, and improve our services; and to send marketing and informational messages.

 

  • Advertising Companies: If you subscribe to an ad supported subscription plan, we may share certain personal information with Advertising Companies (see definition above) in order to select Advertisements shown on Live Kanvas, to facilitate interaction with Advertisements, and to measure and improve effectiveness of Advertisements. These companies may process your personal information for the following purposes: to operate our ad supported subscription plan.
  • Corporate transactions: In connection with a reorganization, restructuring, merger or sale, or other transfer of assets, we will transfer personal information provided the receiving party agrees to respect your personal information in a manner that is consistent with this Privacy Statement. We may disclose your personal information in such instances for the following purposes: to provide our service; to administer and operate our business; to research, analyze, and improve our services; to enable Partner integrations and promotions; to send marketing and informational messages; to operate our ad supported subscription plan; for safety, security, and fraud prevention; and to comply with law and enforce our Terms of Use.
  • Safety, security and fraud prevention: Live Kanvas and its Service Providers may disclose your personal information to third parties where we reasonably believe disclosure is needed for the purpose of: safety, security, and fraud prevention.
  • Compliance with law and enforcing our Terms of Use: We may disclose your personal information as necessary to comply with applicable law, regulation, legal process, or governmental request, and processing necessary to protect against harm to the rights, property or safety of Live Kanvas, its users or the public, as required or permitted by law. We may disclose personal information for the following purpose: to comply with law and enforce our Terms of Use.

 

  1. Your Rights

 

You may submit a request to know, access, correct or delete the information we have collected from or about you here. You may appeal any decision we have made about your request by following the instructions in the communication you receive from us notifying you of our decision. You may also exercise your rights to know, access, correct, delete, or appeal by sending your request to privacy@livekanvas.com. You can also update your account information directly through your in-app settings, as well as request a copy of your Live Kanvas data or request to deactivate by contacting privacy@livekanvas.com.

 

You may be entitled, in accordance with applicable law, to submit a request through an authorized agent. To designate an authorized agent to exercise choices on your behalf, please provide evidence that you have given such agent power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. We will respond to your request consistent with applicable law and subject to proper verification. We will verify your request by asking you to send it from the email address associated with your account or to provide information necessary to verify your account.

 

  1. Your Choices

 

  • You may be able to control some of the Information We Collect through your device browser settings to refuse or disable Cookies. Because each browser is different, please consult the instructions provided by your browser. Please note that you may need to take additional steps to refuse or disable certain types of Cookies. In addition, your choice to disable Cookies is specific to the particular browser or device that you are using when you disable Cookies, so you may need to separately disable Cookies for each type of browser or device. If you choose to refuse, disable, or delete Cookies, some of the functionality of the Platform may no longer be available to you. Without this information, we are not able to provide you with all of the requested services.
  • Your device may have controls that determine what Information We Collect. For example, you can control whether we can collect your mobile advertising identifier for advertising through settings on your Apple and Android devices.
  • You can opt out of marketing or advertising emails by using the “unsubscribe” link or mechanism noted in marketing or advertising emails.
  • If you have registered for an account, you may access, review, and update certain personal information that you have provided to us by logging into your account and using available features and functionalities.
  • If you are a California resident, once a calendar year, you may be entitled to obtain information about personal information that we shared, if any, with other businesses for their own direct marketing uses. To submit a request, contact us at: privacy@livekanvas.com
  • Some browsers transmit “do-not-track” signals to websites. Because of differences in how browsers incorporate and activate this feature, we currently do not take action in response to these signals.

 

8. Data and Security Retention

 

We use reasonable measures to help protect information from loss, theft, misuse, unauthorized access, disclosure, alteration, or destruction. You should understand that no data storage system or transmission of data over the Internet or any other public network can be guaranteed to be 100 percent secure. Please note that information collected by third parties may not have the same security protections as information you submit to us, and we are not responsible for protecting the security of such information.

 

We retain information for as long as necessary to provide the Platform and for the other purposes set out in this Privacy Policy. We also retain information when necessary to comply with contractual and legal obligations, when we have a legitimate business interest to do so (such as improving and developing the Platform, and enhancing its safety, security and stability), and for the exercise or defense of legal claims.

The retention periods are different depending on different criteria, such as the type of information and the purposes for which we use the information. For example, when we process your information such as your profile information to provide you with the Platform, we keep this information for as long as you have an account. If you violate our Terms of Service, Community Guidelines, or other conditions or policies, we may remove your profile immediately, but may keep other information about you to process the violation.
